District Court Pro Se Dissolution Forms
These forms are prepared for your use in obtaining a divorce when you have not retained an attorney to represent you.
You are strongly urged to seek the assistance of legal counsel, especially when there are children involved.
Should you decide to represent yourself during the court proceedings, please follow the INSTRUCTIONS contained in each packet of forms, very carefully, step-by-step.
An initial fee is charged by the Clerk of District Court for filing a new case, reopening a closed case, or for appearing and filing a response. In some cases, the Court will waive the fees. An Affidavit of Indigence must be completed and submitted for approval by the District Judge for a waiver of fees. FORM: AFFIDAVIT OF INDIGENCE
It is your responsibility to keep the mailing address in your case current with the Court. This form is for notification only by a party (Plaintiff/Petitioner or Defendant/Respondent) and does not fulfill the requirements of MCA Section 40-4-217 when the filing of a Notice of Intent to Move with a child is necessary.
FORM: CHANGE OF ADDRESS
|A||Joint Dissolution without Children||If you and your spouse agree to jointly file for a divorce, and do not have minor children.|
|B||Joint Dissolution with Children||If you and your spouse agree to jointly file for a divorce, and you have minor children|
|C||Dissolution without Children||If you are seperately filing the divorce petition and do not have minor children.|
|D||Response to Dissolution Without Children||If you are responding to a divorce petition filed by your spouse, and do not have minor children|
|E||Dissolution with Children||If you are filing the divorce petition and you have minor children|
|F||Response to Dissolution with Children||If you are responding to a divorce petition filed by your spouse, and you have minor children.|
|G||Default Packet - Dissolution||If you have filed a divorce petition in Packet C or E and your spouse has not responded and you want his/her default entered|
|H||Petition for Permanent Parenting Plan||If you are not married to your child(ren)'s co-parent and you want to establish a parenting plan.|
|I||Response to Petition for Permanent Parenting Plan||If you are responding to a petition for a parenting plan which was served to you|
|J||Default Packet - Parenting Plan||If you have filed a petition for a parenting plan in Packet H and the co-parent has not responded and you want his/her default entered|
|L||Joint Petition for Permanent Parenting Plan||
If you are not married to your child(ren's co-parent -- and you both agree and what you want for a parenting plan -- and want to have it on record with the Court.
